Understanding International Humanitarian Law: When Does an Airstrike Become a War Crime?

GENEVA: In response to the ongoing US-Israeli bombardment, the head of a UN probe declared on Monday that an Israeli airstrike on a prison last year was a war crime and issued a warning about the possibility of more persecution.

Iranian authorities claim that during an air conflict with Iran in June of last year, Israel attacked Tehran’s Evin prison, killing around 70 prisoners. The jail, which is well-known for housing political prisoners, has also sustained damage from the most recent US-Israeli airstrikes, which has alarmed the inmates, including a British couple.

The chair of the Independent International Fact-Finding Mission on Iran, Sara Hossain, told the UN Human Rights Council, “We found reasonable grounds to believe that, in carrying out the airstrikes on Evin prison, Israel committed the war crime of intentionally directing attacks against a civilian object.” She claimed that 80 people had died, including eight women and one child.

On Monday, she provided the Council with her most recent report, which was based on witness and victim interviews, satellite imagery, and other documentation. Israel has kept its seat unfilled and disengaged from the council, which investigates and records violations.
