Top Reasons Tech Companies Are Moving Their Intellectual Property to Cyprus

Intellectual property is not a side asset for software companies, SaaS platforms, or any business based on patents and code. It is the advantage. The majority of a company’s true worth is often derived from its brand, algorithms, source code, and patents. However, until an investor, acquirer, or tax body raises the issue, many founders barely consider where that intellectual property is legally. In response, an increasing number of tech firms are using the Cyprus IP Box regime. The combination of a really competitive tax system, complete EU membership, and a degree of legal certainty that is unmatched by more recent low-tax places is the cause.

Deliberately placing IP elsewhere
The previous strategy was to leave intellectual property wherever the business was established, mainly because no one had any other plans. These days, that habit is costly and dangerous. The legal owner of an asset is expected to be the place where actual work and decisions are made, and tax authorities around Europe have tightened the limits on where profit from intellectual property can be taxed. Founders have also realized that the location of their intellectual property has an impact on future investment rounds, valuation, and the tax burden on each euro of exit proceeds or licensing income. A key component of how major technology companies are set up is the deliberate, as opposed to accidental, selection of a home for intellectual property.

What the Cyprus IP box genuinely provides
The Cyprus IP Box, the country’s intellectual property framework, lies at the heart of the Cypriot proposal. An 80% notional deduction is available for qualifying profit from qualified assets, such as patents and copyrighted software. In actuality, this means that corporate tax only applies to a fifth of the qualified IP earnings.
