The proposed prohibitions on under-15s using social media in the UAE may cover streaming services like Netflix, Spotify, gaming networks, and other digital platforms in addition to sites like Instagram and TikTok.
This is because, according to legal experts, the restriction applies to any platform that uses user accounts or algorithmic recommendations. Children under the age of 15 are not allowed to create, use, or manage personal accounts on social media sites, according to the Cabinet Resolution.
Its definition of a social media platform, however, is more expansive than that of traditional social networks, encompassing services that facilitate social interaction, public or semi-public profiles, content publication, or the display and recommendation of material using algorithmic algorithms. Even in cases where they don’t function as conventional social media services, this could lead to more monitoring of streaming services, gaming networks, and apps with recommendation engines.
According to Alex Mackay, senior associate at Reed Smith who specializes in digital platform law, “a platform which only meets one limb of the definition, account creation, social interaction, content publication, or algorithmic recommendation, could satisfy the definition,” he told Arabian Business.
